BTZD Terms and Conditions of Supply for Custom Apparel and Website Use

1. Custom Orders

• All items are custom made based on the artwork and details your approve
• Because they are custom made, change of mind returns are not available

2. Artwork Approval

• You must carefully check all artwork, colours, names, numbers, and details before approving
• Once approved, BTZD produces the order exactly as shown
• BTZD is not responsible for errors that were approved

3. Colour and Fabric Variation

• Digital screens cannot display colours with production accuracy
• Printed colours will differ from what is seen on screen
• Minor variations in colour, placements, or sizing are normal and not considered defects
• Fabrics naturally change over time with wear, washing, and environmental exposure

4. Faulty of Defective Goods

• If you believe something is faulty, please contact BTZD within 7 days and provide photos or videos so we can assess the issue
• All matters are assessed in accordance with the Australian Consumer Law

5. Payment Terms

• A 50% deposit is required before production begins
• The remaining balance must be paid before orders are released
• Schools and approved organisations may have alternative payment terms if agreed in writing

6. Production and Delivery

• Lead times are estimates and may vary due to supplier, freight, customs, or other external factors
• BTZD is not responsible for delays outside our control
• Risk transfers to the customer once the order is delivered or collected

These Terms and Conditions of Supply and Website Use ("Terms") apply to all users of the BTZD website and all customers who purchase products or services from BTZD. By accessing the website, placing and order, or otherwise engaging with BTZD, you agree to be bound by these Terms.

1. Definitions

• BTZD -  we, us, our, means BTZD and any of its related entities, associated businesses, authorised representatives, or personnel involved in supplying goods or services under these Terms
• Customer -  you or your means any person or entity that accesses the website or purchases products or services from BTZD 
• Products - means all custom apparel, merchandise, and related goods supplied by BTZD
• Services - means design, customisation, printing, embroidery, order fulfillment, and related services provided by BTZD
• Website - means the BTZD website and any associated online platforms operated by us
• Order Acceptance - means when BTZD either provides written confirmation of your order (including email confirmation) or commences production of the products

2. Website Use

2.1 Permitted Use

You may use this website for lawful purposes only. You must not:

• Breach any applicable law or regulation
• Infringe the rights of any third party
• Interfere with the security, performance, or functionality of the website, or attempt to gain unauthorised access to any systems or data

2.2 Cookies and Analytics

BTZD website uses cookies to analyse usage and data. The collection and handling of personal information through this technology is governed by our Privacy Policy

2.3 Accuracy of Information

We take reasonable care to ensure website information is accurate and current, however, we do not warrant that content is error free, complete, or up to date. Product images are indicative only and may differ from final products. To the maximum extent permitted by law, BTZD is not liable for any loss, damage, cost or expense arising from your access to or use of the website

2.4 Availability

We may modify, suspend, or discontinue any part of the website at any time without notice. Access to the website may be interrupted or unavailable from time to time

2.5 Third Party Links

BTZD website may contain links to third party websites or resources not owned or controlled by us. These links are provided for convenience only. BTZD does not endorse or make representations about third party websites, content, products, or services. To the maximum extent permitted by law, BTZD is not liable for any loss, damage, cost or expense arising from your access to or use of any third party website

2.6 DYO (Design Your Own) Feature (coming soon)

The DYO (Design Your Own) feature on the website is a visualisation tool only. Any designs created using this tool do not constitute a confirmed order. All orders must go through BTZD's standard order placement and acceptance procedure as outlined in Section 3. BTZD is not responsible for any discrepancies, technical errors, or variations in designs created through the DYO feature

3. Orders and Acceptance

3.1 Order placement

All customer approved orders, including DYO orders constitute an offer to purchase

3.2 Custom Products

Products are custom made to your specifications. Once order approval has occurred orders cannot be cancelled or amended except as required under the ACL

3.3 Refusal or Cancellation

We may refuse or cancel an order where payment cannot be processed, specifications are incomplete, supplied content infringes third party rights, or the order is unlawful or inappropriate

4. Pricing

Pricing is shown in Australian Dollars (AUD) unless stated otherwise and is exclusive of GST unless indicated. Prices may change prior to order acceptance

4.2 Payment

Full payment is required before production commences unless otherwise agreed in writing. All invoices must be paid by the agreed due date. BTZD may suspend production, withhold delivery, or cancel orders in the event of non payment

4.2 (a) Payment Obligations for Custom Made Products

All custom made products must be paid for in full as they are specifically produced for the customer and cannot be resold. Once production has commenced, the customer is legally responsible for the full balance of the invoice, regardless of any subsequent dispute, change of mind, or request for review

4.3 Order Errors (online)

This clause applies to online orders that are placed through the BTZD website only. If a genuine pricing, product description, or typographical error occurs in relation to an online order. BTZD may cancel the affected order and provide a refund of any amounts paid. BTZD is not obliged to honour incorrect pricing information published in error

5.Customer Responsibility

You warrant that all artwork and logos supplied to BTZD are owned by you or are provided with full permission, and that their use does not infringe the intellectual property rights of any third party. The customer indemnifies BTZD against any claims, losses, damages or costs arising from the use of artwork and logos supplied by the customer. Note: The customer is responsible for supplying print ready files suitable for the intended print medium

5.1 Artwork Approval

You are responsible for carefully reviewing and approving artwork proofs and all other details associated with your order. BTZD is not responsible for any omissions or inaccuracies that were approved by you. All digital Mock ups are indicative only and may not represent exact scale, colour, or final production outcome

5.2 Minor variations including colour, size, placement, or finish may occur due to the nature of custom production processes, materials, and printing methods. These variations are considered normal and do not constitute a defect

6. Production and Delivery

Production and delivery timeframes are estimates only and may vary due to circumstances beyond our reasonable control. BTZD is not liable for delays caused by third party suppliers, freight carriers, or other external factors

6.1 Delivery and Risk

Risk in products passes to you once the goods have been dispatched by BTZD for local or interstate delivery, or when you have collected the products directly from us. After dispatch, BTZD is not responsible for loss, damage, or delays caused by freight carriers or other external factors

6.3 Delays

BTZD is not liable for delays caused by third party carriers, force majeure events, or other factors outside our control

7. Returns, Refunds, and Consumer Guarantees

7.1 Consumer Guarantees

Products and Services come with guarantees that cannot be excluded under the Australian Consumer Law. Remedies for any failure will be provided in accordance with the ACL

7.2 Custom Orders

Because products are custom made, we do not accept returns or refunds for change of mind, incorrect information supplied by you, or approved artwork errors

7.3 Faults or Errors

You must notify us within 7 days if products are faulty, damaged, or incorrect. We will assess the issue and provide a remedy in accordance with the ACL. Notifying us promptly helps us resolve the matter efficiently 

8. Intellectual Property

All intellectual property on the website is owned or licensed by BTZD. You must not reproduce, distribute, or otherwise exploit any content without BTZD's prior written consent

9. Limitation of Liability

To the maximum extent permitted by law, BTZD excludes all liability for loss or damage arising from the use of the website or from the supply of any products or services, except where liability cannot be excluded under the ACL. Where liability cannot be excluded, BTZD's liability is limited, at its option, to resupplying the products or services or paying the cost of resupply

10. Indemnity

You indemnify BTZD against any loss, damage, liability, or expense arising from your breach of these Terms, misuse of the website or products, or any materials you supply. This indemnity does not apply to the extent that the loss arises from BTZD's breach of the Privacy Act 1988 (Cth), the Australian Privacy Principles, or other non- excludable laws

11. Privacy

BTZD is a family owned business that is not currently required to comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth). However, we are committed to handling personal information responsibly and in accordance with applicable privacy obligations

12. Force Majeure

BTZD is not liable for failure or delay caused by events beyond its reasonable control, including  but not limited to, natural disasters, industrial action, or supply shortages

13. Governing Law

These Terms are governed by the laws of Australia and the State of Queensland. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms take effect upon publication on the website. Continued use of the website or engagement with BTZD constitutes acceptance of the revised Terms
